1. Products and Descriptions

Our website offers a wide range of used and refurbished foodservice-related items and equipment.  All items are sold as-is, and we make every effort to provide accurate descriptions, images, and specifications for each product. However, due to the nature of used and refurbished products, there may be slight variations from the descriptions provided.

We reserve the right to update, modify, or discontinue products without notice.

2. Product Availability

All products listed on our website are subject to availability. We cannot guarantee that all items will remain in stock. If an item is out of stock or unavailable, we will notify you as soon as possible.

3. Prices and Payment

Prices for products are listed in USD$ and are subject to change without notice. The price you are charged is the price listed on the website at the time of purchase, plus any applicable taxes, handling, and shipping fees.

We accept the following payment methods:

By submitting an order, you authorize us to charge the payment method you provide for the total amount due, including taxes, shipping, handling, and any applicable fees.

4. Shipping and Delivery

Shipping costs will be calculated at checkout based on your delivery address. We offer shipping to the following regions: [list regions or countries you ship to].

• Handling Time: Orders are processed and shipped within five business days, depending on product availability.
• Delivery Time: Estimated delivery times depend on the shipping method and the destination address. While we make every effort to ensure timely delivery, we are not responsible for delays caused by third-party carriers.
• Shipping Damages: Once a product is shipped, we are not responsible for damages caused during transit. Please inspect your order upon receipt, and contact the carrier directly if you notice any damages.

5. Returns and Refunds

All sales are final. We do not offer returns, refunds, or exchanges.

If you believe your item is not as described, please contact us within two (2) days of receiving the item.  When you contact us, submit clear photos to support your concerns.  Your satisfaction is important to us; and we stand behind our products.  We will evaluate these submittals on a case-by-case basis. 

Canceled orders of stock items are accepted, or not, at the discretion of Prime Staging Solutions. Cancellation of a refurbished-to-order item may be accepted with a restocking charge up to 50% or may not be accepted at all, based on the discretion of Prime Staging Solutions.

No Warranty: All products are sold as-is without any warranties or guarantees. While we make reasonable efforts to ensure that our products are functional and in good condition, we do not guarantee the performance, longevity, or condition of any item.

6. Product Warranties and Disclaimers

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Prime Staging Solutions, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the services or products, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Prime Staging Solutions provides no warranty or undertaking, and makes no representation of any kind that the service or product will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither Prime Staging Solutions nor any of its provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the service or product, or the information, content, and materials or products included thereon; (ii) that the Service or product will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service or product; or (iv) that the Service or product, its servers, the content, or e-mails sent from or on behalf of Prime Staging Solutions are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Our products are sold without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.

Any warranties, guarantees, or repairs provided by manufacturers or third-party suppliers for refurbished items are the responsibility of the manufacturer or supplier, not Prime Staging Solutions.

7. Limitation of Liability

To the fullest extent permitted by law, Prime Staging Solutions shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the products, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the product(s) in question.

13. Governing Law and Dispute Resolution

THIS AGREEMENT WILL BE GOVERNED BY THE LAWS OF THE UNITED STATES AND THE COMMONWEALTH OF VIRGINIA, WITHOUT REFERENCE TO RULES GOVERNING CHOICE OF LAWS. ANY ACTION RELATING TO THIS AGREEMENT MUST BE BROUGHT IN THE FEDERAL OR STATE COURTS LOCATED IN LYNCHBURG, VA, AND YOU IRREVOCABLY CONSENT TO THE JURISDICTION OF SUCH COURTS.

13.1 Compliance with Laws

You shall, at all times, comply with all applicable laws and regulations regarding the use of the Services and purchase of items on the Site. You shall indemnify and save Prime Staging Solutions harmless from your failure to so comply. You agree that Prime Staging Solutions shall not have to perform any obligations set forth in this Agreement if such performance would violate any present or future law, regulation, or policy of any applicable government.

13.2 No Agency

Prime Staging Solutions is not the agent, fiduciary, trustee, or other representative of you. Nothing expressed or mentioned in or implied from this Agreement is intended or shall be construed to give to any person other than the parties hereto any legal or equitable right, remedy, or claim under or in respect to this Agreement. This Agreement and all of the representations, warranties, covenants, conditions, and provisions hereof are intended to be and are for the sole and exclusive benefit of the parties hereto.

13.3 Severability

Should any term or provision hereof be deemed invalid, void or unenforceable either in its entirety or in a particular application, the remainder of this Agreement shall nonetheless remain in full force and effect and, if the subject term or provision is deemed to be invalid, void or unenforceable only with respect to a particular application, such term or provision shall remain in full force and effect with respect to all other applications. Further, if any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision and the other provisions of this Agreement shall remain in full force and effect.

13.4 Claim Limitation

You agree regardless of any statute or law to the contrary that any claim or cause of action arising out of or relating to the Site, use of the Services, or this Agreement must be filed within one (1) year after such claim of action arose or be forever barred.

13.5 Waiver

Prime Staging Solutions’s failure to enforce the strict performance of any provision of this Agreement will not constitute a waiver of Prime Staging Solutions’s right to subsequently enforce such provision or any other provisions of this Agreement.

15. Entire Agreement

This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof and supersedes and cancels all prior and contemporaneous agreements, claims, representations, and understandings of the parties in connection with the subject matter hereof.
